			<content:encoded><![CDATA[<p>Triple Eight Distribution, Inc. of New York, in cooperation with U.S. Consumer Product Safety Commission (CPSC) is recalling about 30,400 Triple Eight Distribution children and youth bicycle helmets because the helmets pose a <a href="http://www.tomkileylaw.com/practice-areas/traumatic-brain-injury.html">head injury hazard</a>.  The helmets were determined to be in violation of the CPSC impact resistance safety standards and this violation prompted the recall.</p>
<h3>Recalled Product Details</h3>
<p>The following multi-purpose helmets, which were also sold as bicycle helmets, are included in the CPSC recall:</p>
<ul>
<li><strong>Little Tricky Helmets</strong> – These child helmets have a large Little Tricky logo on both sides of the helmet and were sold in black, green, pink, and white in only one size.</li>
<li><strong>Sector 9, size S/M, EPS Liner Helmets</strong> – These were sold in white, blue, black, and green and have a hard black inner EPS foam liner. There is also an interior label which has the size, S/M, and the manufacture date on it.</li>
<li><strong>Triple Eight, size S/M, EPS Liner Helmets</strong> – These were sold in bone, black, white, blue, and army green and have the same inner EPS foam liner as mentioned above, as well as an interior label with the size and manufacture date of the helmet.</li>
</ul>
<p>The recalled helmets were manufactured in China and were sold at sporting goods and bicycle stores, other retailers nationwide, and online for about $40 from August 2006 through November 2011. Consumers should immediately contact Triple Eight for a full refund.</p>

<strong>Focusing on Child Safety</strong></p>
<p>According to the Consumer Product Safety Commission (CPSC), a variety of newly implemented safety standards have made a big difference in protecting children from injuries as the result of dangerous or <a href="http://www.tomkileylaw.com/library/defective-toys-injure-childrenlegalissuesandoverma/">defective toys</a>. These include:</p>
<ul>
<li>Strictly limiting the use of certain phthalates;</li>
<li>Establishing the lowest worldwide lead paint and lead content limits;</li>
<li>Requiring third party testing and certification of toys intended for children 12 years old or younger;</li>
<li>Mandating toy standards that were once voluntary; and</li>
<li>Tracking toy shipments being imported to the U.S. with the help of Homeland Security, thus increasing seizure of dangerous imported toys.</li>
</ul>
<p>These standards have created a safer toy market, as proven by the decline of toy recalls since 2008, which had 172. Toy recalls in 2009 further declined to 50; and in 2010, the number of recalls dropped even further to 46. Finally, during the 2011 fiscal year, toy recalls declined to 34. Lower numbers of recalls do not necessarily mean lower numbers of child injuries, however.</p>
<p><strong>Defective Toys Still Endanger Children</strong></p>
<p>Stronger toy safety regulations are a step in the right direction, but dangerous toys that slip through the cracks can still cause serious injury to children. In 2010, unsafe toy-related child deaths increased to 17 for children younger than 15. Furthermore, there were 15 reports of toy-related child deaths in 2009. Almost half of these fatal defective toy accidents involved choking on rubber balls, balloons, and small balls.</p>

			<content:encoded><![CDATA[<p>A recent study has found that the number of yearly child brain injuries in the United States has decreased in the past several years; however, the death rate for children who have suffered a <a href="http://www.tomkileylaw.com/practice-areas/traumatic-brain-injury/">traumatic brain injury</a> (TBI) has stayed the same. The study was presented at the American Academy of Pediatrics in Boston and drew its information from child TBI cases from 2005 to 2008, according to <em>Myhealthnewsdaily.com</em>.</p>
<p>The study catalogued 175,261 child TBI incidents and found that by 2008, the number of yearly injuries had been reduced to 36,884 from 50,088 in 2005. According to researchers, the drop in injuries is mostly likely caused by an increase in head injury awareness and greater use of bicycle helmets.</p>
<p><strong>Child Brain Injury Fatalities</strong><br />
Even with the large decrease in the amount of child brain trauma, the fatality rate remained the same in every year examined by the study: 3.5 percent of injury victims. Of all child age groups, newborns were the most likely to die of their head injuries, with the group being 2.8 times more likely to die than the average child.</p>
<p>The study also found that the four most common causes of child TBI were:</p>
<ul>
<li>Being struck by a car;</li>
<li>Being in a vehicle involved in an auto accident;</li>
<li>Suffering a fall; and</li>
<li>Being involved in a bicycle accident.</li>

According to a recent article in <i>The Boston Globe</i>, the new eco-friendly program will hopefully also result in more bicyclists wearing their <A href="http://www.tomkileylaw.com/library/bicycle-helmet-injury-attorney-boston-child-injury-lawyer-boston-ma/">bike helmets</A> whenever they go out for a ride.</p>
<p>With the warmer weather still here, kids are enjoying being out of school and many ride their bicycles through their neighborhood or local parks.  However, the <i>Globe</i> article reported that less than 50% of all kids who ride bikes actually wear their helmets and about 50% of injuries stemming from bicycle accidents require medical attention, specifically for treatment of a head injury.</p>

			<content:encoded><![CDATA[<p>Erica Ryan, 25, of Roxbury faces a charge of assault and battery on a child that stemmed from an incident last Tuesday afternoon on an MBTA bus in Roxbury, after Ryan reportedly punched her 2-year-old son in the mouth and caused him to bleed.  </p>
<p>Thankfully, her fellow MBTA riders stopped Ryan from walking away and immediately called police to report what they had witnessed.  </p>
<p><i>The Boston Globe</i> reports that around 3:30pm that day, police responded to a group of individuals who had surrounded Ryan and her infant.  </p>
<p>Ryan had reportedly been attempting to feed her toddler while on the Route 23 bus.  When her son would not eat, Ryan used vulgarities and obscenities towards the child and then punched him in the mouth.  </p>
<p>After Ryan punched her son, MBTA riders approached her and the boy out of concern for his well-being after seeing the <A href="http://www.tomkileylaw.com/practice-areas/child-injury/">child abuse incident</A> and called police.  When Ryan tried to leave the bus, the riders continued to follow her and then surrounded her, in order to prevent her from leaving before police responded.</p>
<p>Police confirmed that the toddler had dried blood around his mouth from being hit.  There is also security footage of the shocking situation and it reportedly shows Ryan hitting her son, with his head snapping back while seated in his stroller. </p>
<p>The little boy was taken to a Boston hospital for an evaluation and was then released to his grandfather.</p>
<p><b>Child Abuse Statistics</b><br />
The Centers for Disease Control and Prevention (CDC) report that child protective services identified 772,000 children in the U.S. in 2008 who were suffering from abuse, neglect, or another form of maltreatment.</p>

			<content:encoded><![CDATA[<p>Carlos Edwards, 34, of Melrose faces serious <A href="http://www.tomkileylaw.com/library/child-injury-attorney-boston-children-abuse-lawyer-massachusetts/">child abuse</A> charges following a July 20 incident when Edwards reportedly threw his then 7-week-old son, Carmello Sears, to the ground as Edwards and the infant’s mother, Crystle Sears, were arguing outside of Sears’ home in Malden. </p>
<p><b>What Happened</b><br />
Edwards had gone to Sears’ home in Malden to ask her for money.  Sears is reportedly Edwards’ girlfriend of two years.  An argument ensued and, at some point, Sears gave Carmello to Edwards and also gave him her EBT card as Edwards continued to hold the baby.  </p>
<p>The argument continued and escalated, which is when Edwards reportedly threw Carmello approximately 4 feet in the air.  The infant bounced off of Crystle and landed on the pavement.  Two witnesses immediately contacted police and reported what they had seen.</p>
<p>According to <i>The Boston Globe</i>, Carmello had suffered a double skull fracture, a blood clot in his brain, and his leg was broken from the fall.  </p>
<p>Carmello was released from a Boston hospital on July 28 after a stay in the intensive care unit and is said to be recovering from his severe <A href="http://www.tomkileylaw.com/practice-areas/child-injury/">child abuse injuries</A>.  The long-term effects due to the fall are unknown.</p>
<p>Edwards has been held without bail since his July 28 dangerousness hearing in Malden District Court.  He has entered not guilty pleas to charges of assault and battery with a dangerous weapon and assault and battery on a child causing serious injury.  Edwards is expected back in court on August 18.</p>
<p><b>Shaken Baby Syndrome &#038; Injuries to Infants</b><br />
Thankfully, Carmello is recovering from this horrific incident, instead of the incident ending in tragedy.  </p>

			<content:encoded><![CDATA[<p>Emanuel M. Quadros, 32, of Lawrence was arraigned in Lawrence District Court on Wednesday on charges that he inflicted severe brain injuries on his infant son resulting in the little boy’s blindness.</p>
<p>Quadros, who pleaded not guilty, is being held in lieu of $75,000 cash bail. His charges include <b>assault and battery on a child under 14 causing substantial injury</b>.</p>
<p>According to the authorities, Quadros allegedly dropped his 3-week-old son on May 18th. Quadros told investigators that he panicked when the boy lost consciousness and took him to the other room, placed the baby on the bed, slapped him multiple times, and bounced him up and down while holding the child under his arms. </p>
<p>As a result of all this, the little boy, Jackson Quadros, suffered serious injuries such as:</p>
<ul>
<li>several broken bones,</li>
<li>fractures to his right leg,</li>
<li>loss of consciousness, and</li>
<li>severe brain injuries resulting in blindness.</li>
</ul>
<p>The baby was initially taken to Holy Family Hospital in Methuen, then transferred to Children’s Hospital in Boston. He has since been transferred to a nursing home.</p>
<p>The boy’s injuries were so severe that he is now blind, and is most-likely to be wheelchair-bound, according to police.</p>
<p>The boy’s father initially blamed his wife, Pamela Cook, for his son’s injuries, but investigators thought otherwise. Quadros is schedule to appear next in court on September 9th.</p>
<p><b>Child Injuries From Shaken Baby Incidents</b></p>
<p>Jackson Quadros is not the only baby that has suffered such traumatic injuries in the hands of his father. 			<content:encoded><![CDATA[<p>An unidentified 3-year-old boy nearly drowned this past Saturday afternoon around 1:00pm at Curlew Pond on the grounds of the Myles Standish State Forest in Plymouth.  Local police and staff of the Department of Conservation and Recreation (DCR) performed CPR on the little boy and were able to revive him.  </p>
<p>When emergency workers had initially responded to the call, the boy was out of the water and semi-conscious.  According to <i>The Boston Globe</i>, the boy reportedly coughed up water once he was revived.  </p>
<p>The unnamed boy was then transported to an area hospital and airlifted to a Boston hospital for further treatment.  Curlew Pond has warnings posted to alert swimmers that there are no lifeguards on duty.</p>
<p><b>Drowning Incidents in the News</b><br />
Last week, there were three <A href="http://www.tomkileylaw.com/library/drowning-accidents-massachusetts/">tragic drowning incidents</A> across Massachusetts that claimed the lives of three 4-year-olds.  </p>
